WELCOME TO THE BUM CLUB LOYALTY PROGRAM (“THE BUM CLUB” OR THE “PROGRAM”) OFFERED BY SUN BUM LLC (“SUN BUM,” “WE,” “US,” OR “OUR”). BY ENROLLING, ACCESSING, AND/OR OTHERWISE PARTICIPATING IN THE BUM CLUB, YOU AGREE THAT YOU HAVE READ AND YOU UNDERSTAND THESE PROGRAM TERMS AND CONDITIONS (“PROGRAM TERMS AND CONDITIONS” OR “THE BUM CLUB TERMS AND CONDITIONS”) AND AGREE TO BE BOUND BY THEM. PLEASE READ THESE PROGRAM TERMS CAREFULLY. THEY INCLUDE LIMITATIONS ON SUN BUM’S LIABILITY, A BINDING ARBITRATION CLAUSE FOR RESOLUTION OF DISPUTES, WHICH MEANS A JURY WIL NOT HEAR POTENTIAL CLAIMS, AND CLASS ACTION WAIVER. In addition to these Program Terms and Conditions, your participation in The Bum Club is subject to our Website Terms of Use located HERE, which are made a part of these Program Terms and Conditions and are expressly incorporated herein by this reference. Please read the Website Terms of Use before participating in The Bum Club. This Program is included in the definition of “Service” as that term is used in the Website Terms of Use. If there’s ever a direct conflict or inconsistency between The Bum Club Program Terms and Conditions and Sun Bum’s Website Terms of Use, these Program Terms and Conditions will control to the extent the conflict relates specifically to The Bum Club. Otherwise, the Website Terms of Use continue to apply in full.
Information collected in connection with The Bum Club is governed by Sun Bum’s Privacy Policy (“Sun Bum Privacy Policy”) which you can find HERE which is made a part of these Program Terms and Conditions and is expressly incorporated herein by this reference. Please read the Sun Bum Privacy Policy as it explains how we collect, use and share your personal information and includes information about how to update or change the ways Sun Bum communicates with you. If there is any inconsistency between these Program Terms and Conditions and the SB Privacy Policy, the SB Privacy Policy will control. In addition, California law requires we disclose specific information about financial incentives we offer, and Colorado requires similar information when it comes to “Bona Fide Loyalty Programs.” Other states may have similar laws. You can read this information at our Notice of Financial Incentive HERE. By participating in The Bum Club, you are consenting to the privacy practices described in the Sun Bum Privacy Policy and Notice of Financial Incentive.
As a condition of membership in The Bum Club, you will be asked to provide a valid email when you enroll, which Sun Bum and authorized third parties will use to communicate with you about your account and as otherwise permitted by applicable law in accordance with our Privacy Policy. You may also be presented with an opportunity to indicate your preferences for optional marketing communications. You are not required to consent to marketing communications in order to join The Bum Club.
When you sign up for The Bum Club, you will also have the option to provide your mobile number, but it’s not required. Participants who choose to opt-in to SMS marketing acknowledge that Sun Bum or authorized third parties may send them commercial text messages using automated technology and you consent and agree to that type of contact. Note that some optional features or activities within the Program may require opt-in to SMS marketing to participate. If this is the case, you will be provided with notice before you choose to participate in that particular activity. Some super Sun Bum fans may have previously signed up to receive marketing text messages from us. We want to let you know that by enrolling in The Bum Club, you’ll also hear from us with loyalty-related updates (like Bananas balance and reward info) via text. You can opt out at any time
The Bum Club is open to U.S. residents of the fifty (50) United States and the District of Columbia (“D.C.”) who are at least eighteen (18) years of age or older with legal capacity to enter into a contract at the time of sign-up. Participation is limited to individuals for personal use only and is limited to one (1) account per person. Membership in The Bum Club is entirely voluntary and does not require a purchase or any other cost or fee to join. We might call you a “member” or “participant” in these Program Terms and Conditions and related communications. Just because you are a member of The Bum Club doesn’t mean you are enrolled in or have any benefits in similar programs of any other Sun Bum affiliate or parent company. We may request proof of eligibility from you at our discretion. This Program is void where prohibited by law.
Eligible participants in The Bum Club can earn “Bananas” in two (2) ways. First, you can earn Bananas for making qualifying purchases on sunbum.com (“Website”) as further described in Section 6 below. Second, you can earn Bananas for interacting with Sun Bum in other ways that we dream up (“Activities”) as further described in Section 11 below and as may be updated by us from time to time. (Other companies might call them “points,” but we thought “points” sounded boring, so we’re calling them “Bananas” -- admit it, Bananas sound more fun). You start accumulating Bananas for purchases and other Activities completed on and after your date of enrollment. When you have enough Bananas, you can redeem them for various products, discounts, and other offers (each a “Reward”) subject to availability and as further described in Section 12 below. Together, your Bananas, Rewards, account status and all other Program benefits may be collectively referred to as “Program Offers.” Don’t worry, if you purchase our products IRL at an authorized retailer, you can still earn Bananas. (That’s covered in “Receipts or it didn’t happen” in the Activities chart in Section 11). All transactions involving Bananas (earning and redeeming) are subject to review and verification by Sun Bum.
The Program and its benefits are offered by us at our sole discretion. Stuff happens. So, in that spirit, Sun Bum reserves the right to change, modify and/or cancel The Bum Club, any aspect of The Bum Club, or any portion of these Program Terms and Conditions (or any other policies related to this Program) from time to time, without advance notice to you in our sole discretion. This includes, without limitation, changes to Bananas conversion or Rewards offered even if such changes may impact your ability to use Bananas you have already earned. If Sun Bum decides to change these Program Terms and Conditions, we will post an updated version HERE (or another URL that Sun Bum may designate) with an update to the “last updated” date located at the top of these Program Terms and Conditions. We may also choose to send an email notifying you of any such changes, but we are not obligated to do so, and you waive any right you might have to such notice. Members should check this page periodically for updates. ANY CHANGES TO THESE REWARD TERMS WILL BE EFFECTIVE UPON POSTING THE REVISIONS. Your continued participation in or access to The Bum Club in any way (e.g., logging in to your The Bum Club account, earning or redeeming Bananas) after we post any changes confirms you agree to the Program Terms and Conditions as modified. In the event we cancel The Bum Club for any reason, your membership terminates, and all Program Offers, including Bananas and Rewards, may be voided.
You can voluntarily enroll in The Bum Club on our Website HERE. Follow the prompts to create an account and enroll in The Bum Club. Required information for sign-up includes your first and last name, valid email address, and password . Your account will give you access to our online shopping experience and the Loyalty Program. If you already have an account set up on our Website and want to join The Bum Club, you can click the “Sign Up” button on that same page or otherwise follow the instructions made available by us on our Website and via The Bum Club widget accessed from our Website (“Loyalty Dash”) to enroll. Following enrollment, you can also optionally elect to complete your profile with additional information like your birthday, bio, home address, future product “wish list,” and mobile phone number, or even a profile pic, but that’s your call. Some Rewards require additional information from you. For example, we need your address to ship physical Rewards, and we can’t send you a birthday surprise if you haven’t shared your birthday. Existing account holders may also receive an email from us with information and instructions about how to join The Bum Club. You won’t be able participate in The Bum Club until you acknowledge that you have reviewed and accepted the Program Terms and Conditions as well as our Website Terms of Use and Privacy Policy The information you provide must be true, accurate, and up to date.
Following your enrollment in The Bum Club, for every one-dollar ($1) you spend on qualifying purchases on our Website (pre-tax and shipping) you will be awarded one (1) Banana. You must be logged into your The Bum Club account at the time you place your order on our Website to earn your Bananas, and Bananas are calculated on the actual purchase price paid, meaning after any discount, coupon, Reward redemption, or promotional offer is applied. For purposes of accruing Bananas, taxes, shipping, and other fees will not be counted. Bananas are rounded down to the nearest whole dollar spent and will be credited to your The Bum Club account after your qualifying order is processed. For example, a purchase of $19.75 = 19 Bananas. Previously awarded Bananas may be deducted for any returns, credits, refunds, or voided transactions. This means if you earn Bananas on an item you purchased on our Website and then return the item for a refund, we will deduct the Bananas based on the value of the returned item(s). If due to such a return your account has a negative Bananas balance, Bananas earned in the future will be applied to the negative balance until the return amount is satisfied. If this happens, we can also adjust or cancel pending Rewards in our discretion. Additional exclusions may apply. For example, you can’t earn Bananas on purchases of gift cards, donations or other fees (if any). We reserve the right to impose limits on the numbers of Bananas you can earn should we deem it necessary.
The Bum Club members who also maintain an active product subscription on our Website are eligible to earn double Bananas (2x) on subscription orders starting with their second successfully processed subscription installment. In case math isn’t your thing, that means that instead of the standard earnings of $1 (pre-tax/shipping) = 1 Banana, subscribers can earn 2 Bananas for every $1 spent on eligible subscription orders. Orders placed on sunbum.com prior to the second installment or after cancellation of your subscription will earn the standard Bananas rate.
You may access and update your information and access your account status, including Bananas balance, by logging in to your The Bum Club account. Bananas will typically appear in your account within one (1) to two (2) business days of the date your qualifying purchase at sunbum.com is processed. Bananas earned in connection with other Activities will typically appear within the time period identified in connection with each Activity, or if no time period is identified, within three (3) business days of your verified completion of the applicable Activity.
BANANAS ARE VALID ONE (1) YEAR FROM THE DATE THEY ARE EARNED, WHETHER THROUGH WEBSITE PURCHASES OR ACTIVITIES. ALL UNUSED BANANAS AUTOMATICALLY EXPIRE ONE (1) YEAR FROM THE DATE THEY ARE EARNED WITHOUT ANY FURTHER NOTICE FROM SUN BUM. This means that your Bananas may expire on different dates depending on when you earned them. Expiration of Bananas is subject only to notice to you that is required by law, if any.
Don’t forget, you must be logged into your The Bum Club account at the time you place your order on our Website because we need to know who you are in order to award you those beautiful Bananas. Bananas will not be awarded, for example, if you check out as a “guest.” Except as Sun Bum may permit on a case-by-case basis in its sole discretion, Bananas will not be awarded retroactively. In other words, if you make a purchase on the Website and aren’t logged in, Bananas will not be later credited. Bananas will not be awarded for purchases or other Activities made prior to your enrollment in The Bum Club.

| Get Inked | Upload a photo of a Tattoo of Sonny (real or temporary, your choice) | 1x | 20 | If you decide to go the permanent route, you must be of legal age to get tattooed in your State, and the tattoo must be done legally by a licensed professional. We are not responsible for any complications, infections, reactions, or other issues related to your tattoo. You accept full responsibility for your decision to get inked. You can redeem your earned Bananas currently available on your account for various Rewards. The required number of Bananas will then be subtracted from your Bananas balance following your Reward selection. Redemptions are final. Rewards may change over time depending on availability as well as member interest. Current Rewards and the number of Bananas required to redeem, as well as additional instructions related to specific Rewards, are available on the Loyalty Dash. There may be a limited number of particular Rewards available, and those Rewards will be provided on a first-come, first-served basis while supplies last. Sun Bum reserves the right to modify, amend, or revise the Rewards or any Program Offers. Participants may not rely on the continued availability of a particular Reward. The number of Bananas required to redeem a Reward may be substantially increased, any Reward may be withdrawn, and restrictions on redemption may be imposed by Sun Bum or the third party supplying the Reward (if any). Physical Rewards will be shipped to U.S. addresses only (50 U.S. and DC, no P.O. Boxes). Sun Bum reserves the right to substitute Rewards of comparable or greater value if any Reward becomes unavailable for any reason. Unless otherwise specified, physical Rewards will be fulfilled within six to eight weeks from date of redemption. Rewards pictured in any point-of-sale, online, promotional packaging, advertising, and/or other Sun Bum materials are for illustrative purposes only. The actual Reward may vary from the Reward pictured.
Rewards Expiration: Rewards in the form of discounts or free shipping on our Website must be used within 30 days from issuance. Some Rewards (e.g., the shopping spree) require you to schedule, attend, complete a specific action, or provide additional information (such as a home address) to claim them. If you redeem your Bananas for one of these and don’t show up, don’t respond, or otherwise fail to complete the required steps to claim your Reward within 30 days from redemption (unless a longer expiration is otherwise indicated), the Reward will be considered forfeited, and your Bananas will not be refunded or reinstated. We’ll do our best to give you reminders, but it’s up to you to follow through. You acknowledge that Sun Bun has not made any representation, warranty or guarantee, express or implied with respect to any Program Offer.Rewards include, but are not limited to, those outlined below and may be updated by us from time to time.

Everyone begins at Level 1 upon joining and can climb to higher levels by accumulating Bananas. Tier status is based on total Bananas earned within the calendar year (January 1st -December 31st). All Bananas counting towards the next membership level will restart at the beginning of each calendar year. If you reach Level 2 or Level 3, you will retain that status for the life your membership in The Bum Club as long as you make at least one (1) purchase of any value on sunbum.com during the calendar year. If you don’t make a purchase at sunbum.com for all of the applicable calendar year, your status will be reset to Tier 1 the next Jan 1st. Note! You can redeem Bananas along the way and still reach the next tier because we keep track of when your total hits the threshold.

Bananas, Rewards, and/or any other Program Offers under The Bum Club are promotional and have no cash or other pecuniary value, cannot be exchanged for cash, are not gift certificates, and have no value outside of this Program. Program Offers cannot be sold, shared, gifted, assigned, bartered, or otherwise transferred, provided that if a Reward is expressly transferrable, you can transfer such Reward in accordance with its specific, applicable terms. You cannot combine your Bananas or other Program Offers with the Program Offers of any other participant in the Program. No credit or cash will be given for unused Bananas. You have no ownership interest in Bananas, Rewards, your account, or any other Program Offers and Program Offers maybe revoked by Sun Bum at any time as set forth in these Program Terms and Conditions. Use of the word “earn” is meant to mean “collect” and “spend” is meant to mean “use.”
Yeah, we told you this already, but the Program and its Program Offers are intended for individual, personal use only. If you are a business or are purchasing products for resale or commercial purposes, you are not eligible to earn Bananas on those purchases. We reserve the right to review and void any Bananas on purchases that we determine, in our sole discretion, were made for resale or commercial use. And just in case you were wondering, teams, clubs or similar groups of individuals are also not eligible to participate.
If you reasonably believe Bananas were not properly credited to your account, you must notify us by contacting hey@sunbum.com within thirty (30) days of the date on which such Bananas should have been awarded per these Program Terms and Conditions. You agree that our determination with respect to Bananas accrued shall be final. Sun Bum reserves the right to determine the number of Bananas in your account based on our internal records. Our internal records will be deemed accurate and in the event of any inconsistency between the number of Bananas stated in your account and Sun Bum’s records, our records control. We can adjust or void Bananas at any time, consistent with these Program Terms and Conditions.
Once you redeem your Bananas for Rewards (including Discount Codes), those Bananas are considered used, and they won’t be refunded, reinstated or reversed. For example, if you trade your Bananas for a Reward in the form of a Discount Code then use that Discount Code to make a purchase on our Website and then return the item you purchased using the Discount Code, your used Discount Code/Bananas will not be reinstated. If we determine there is some kind of rare Banana emergency, we may, at our discretion, reinstate Bananas in limited circumstances.
We reserve the right to suspend, investigate, or terminate any membership and/or suspend or void Program Offers at any time with or without notice for any reason, including, without limitation, for ineligibility, suspected fraud or abuse (e.g., unusually rapid accrual of Bananas), manipulation of the Program (including an individual registering more than one account), conduct inconsistent with these Program Terms and Conditions or our other policies, and/or for violation of any local, state, or federal laws. In the event your participation in the Program is terminated, all earning and redemption activities will be suspended and all accumulated Bananas and Rewards in your account are void upon the date of termination. Suspension or termination or similar actions taken by Sun Bum in connection with the Program, such as Bananas adjustment, will in each case be final and conclusive. Fraud or abuse including use of The Bum Club for unlawful or unauthorized purposes by members may not only result in cancellation of your membership but may impact your eligibility for participation in other Sun Bum programs. Sun Bum will have the right to take appropriate administrative or legal action as it deems necessary in its sole discretion. We’ll always aim to communicate clearly and fairly, but all questions or disputes regarding Program Offers, eligibility, awarding or earning of Bananas or your compliance with these Program Terms and Conditions will be resolved by Sun Bum in its sole discretion.
Certain Activities in The Bum Club may give you the option to submit content (such as photos, captions, comments or other material in connection with earning Bananas). Any such content you submit in connection with the Program is considered “User Contributions“ as defined in our Website Terms of Use. Just to be clear, you agree to be bound by the "User Contributions" Section in our Terms of Use located HERE which is expressly incorporated herein by reference. In addition, and without limiting the foregoing, the following Program-specific terms apply.
We may occasionally offer limited-time bonus Bananas opportunities or additional ways to earn Bananas. If we do, we will tell you how those work at the time, including requirements, additional terms that must be met or accepted, timing and any other relevant details. These opportunities may vary, and participation is always voluntary.
We reserve the right to terminate or suspend any account that has no qualifying participation for twelve (12) months. We may do this without providing any notice to you. You can always rejoin later as a newbie again. Qualifying participation includes simply logging in, updating your profile, earning or redeeming Bananas, completing an Activity or any other action we count as participation.
Please don’t use bots, scripts or other automated means to interact with The Bum Club. We love tech, but only when it plays fair. Automated tools that try to game the system will get shut down—and so will your account.
We are not responsible for any problems, or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail as a result of technical problems or traffic congestion on the Internet or at any website, including any resulting error in computing qualifying purchases or any unavailability of Rewards, or any injury or damage to any participant's or any other person's computer or mobile device related to or resulting from participation in The Bum Club. If, for any reason, the Program is not capable of running as planned, including due to errors of any kind or nature (technical or human), infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, acts of God, acts or omissions of third parties (e.g., Reward fulfillment providers), or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Program, we reserve the right in our sole discretion to cancel, terminate, modify, or suspend the Program or otherwise respond to the circumstances as Sun Bum deems appropriate.
Despite best efforts, errors do occasionally happen. We reserve the right to correct such errors at any time even if it impacts pending Bananas or other Program Offers. This could mean an adjustment to your account status or Bananas balance at any time, without notice, due to technical errors or miscalculations or other reasons which Sun Bum determines is appropriate.
You can only have one account registered to you. Sun Bum may, at its sole discretion, suspend, cancel or combine accounts that appear to be duplicative. You are responsible for the accuracy and completeness of the information you provide. Failure to keep your account information current and complete may result in forfeiture or lapsing of Program Offers. Sun Bum is not responsible for any Program Offers you may miss due to incomplete or incorrect account information. In the event of a dispute over the identity of a member, we will look to the registered account holder of the email address associated with the account. A member may be required to show proof of being the registered account holder of such email address. This is defined as the person assigned to an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses.
You are responsible for keeping your password and any account credentials confidential and for making sure that no unauthorized person has access to your account. You are responsible for all activities that occur under your password, and we may rely on the authority of anyone accessing your account or using your account credentials. You agree to let us know about any unauthorized activity or other breach of security on your account. If you notify us that your account is no longer secure or accessible to you, we may deactivate it at our discretion to prevent misuse.
Just to be clear, you agree to be bound by the Indemnification Section in our Website Terms of Use which is expressly incorporated herein by reference. Without limiting the foregoing and except to the extent prohibited under applicable law, you agree to indemnify, defend, and hold harmless Sun Bum, its parents, subsidiaries, divisions and affiliates, and each of their respective officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, or expenses, including attorneys’ fees and costs, that may arise from or in connection with (a) violation of these Program Terms and Conditions by you or anyone acting on your behalf; (b) any User Contribution you provide; and (c) your violation of any law or the rights of a third-party.

If those efforts fail, we believe that arbitration is a faster, more convenient and less expensive way to resolve disputes rather than in court. Just to be clear, you agree that, as described in the Arbitration Section of our Website Terms of Use which is expressly incorporated herein by reference, any claims you may have arising out of or relating in any way to the Program including these Program Terms and Conditions will be resolved on an individual basis by final, confidential, and binding arbitration before a single arbitrator administered by JAMS or its successor (“JAMS”) and conducted in accordance with the JAMS Streamlined Arbitration Rules And Procedures in effect at the time the Arbitration is initiated or, if the amount in controversy exceeds $100,000, in accordance with the JAMS Comprehensive Arbitration Rules And Procedures then in effect (respectively, the “Applicable Rules”). AS A CONDITION OF PARTICIPATING IN THE BUM CLUB, YOU AGREE THAT ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PROGRAM, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.
To cancel your membership in the Bum Club at any time, log into your account and follow the prompts under your account settings to discontinue your participation and cancel your membership. You can also email us at hey@sunbum.com or call us at 1-877-978-6286. Your membership in The Bum Club will be terminated within thirty (30) days, and subject only to notice that may be required by law, all Program Offers will expire and become void upon the date of termination. If you do decide to cancel your enrollment in The Bum Club and you later re-enroll, you will be treated as a new member of The Bum Club. Cancellation of your membership in The Bum Club will stop your ability to earn or redeem Bananas but will not cancel your account.
